When is a collection agency the right choice?

An agency is the right choice when you would rather pay only from results and hand the work off. It also handles cases that small claims cannot: many accounts at once, a debtor who has moved or must be traced, a debtor in another state or country, and balances above your state's limit. Our page on commercial collection agencies covers how they work and how to pick a certified one.

Before any of these routes, it helps to have run a fixed reminder schedule. Our guide to AR collections for small businesses sets out the steps and the days.

When does small claims make more sense?

Small claims usually costs the least in cash when you have one invoice under the limit, from a business you can identify and serve. The court fee does not rise with the size of the debt, and you can usually ask for costs to be added to the judgment. The cost is your time: preparing the claim, arranging service and attending the hearing. Our guide to small claims for an unpaid invoice covers each step, and Easy Small Claims or a collection agency shows where our flat fee fits.

When do you need a lawyer?

Most businesses handle small claims without one. A lawyer is worth paying for when the balance is above the small claims limit, the client disputes the work or says you owe them, the contract has unusual terms, or the debtor has filed for bankruptcy. How do you decide which route to take?

Run three checks in order, and stop at the first that settles it.

  1. Is it over the limit?

Above $20,000 in Texas, use an agency or a lawyer. Under it, keep going.

  2. Can you find and serve the debtor?

If the business has vanished or is out of state, an agency's tracing and network may do better.

  3. Is the debt disputed?

If the client disputes the work or threatens a counterclaim, talk to a lawyer. If not, a demand letter and then small claims is usually the cheapest route.

Questions, answered

Is it better to use a collection agency or small claims court?

It depends on the debt. An agency suits many small accounts, debtors who must be found and balances above the small claims limit, and costs nothing unless it collects. Small claims suits one invoice under the limit from a business you can serve, and costs a filing fee and service instead of a share of the money.

How much does a lawyer charge to collect a debt?

Lawyers bill by the hour or take a contingency share. Clio's 2025 data puts the average Texas collections lawyer at $321 an hour. On contingency, a common commercial schedule is 20% of the first $300, 18% of the next $1,700 and 13% of the rest, which works out to $1,146 on an $8,000 debt.

Can I get court costs back if I win in small claims?

Usually you can ask the judge to add your filing fee and service costs to the judgment. That makes them part of what the debtor owes you. You still pay them up front, and you only get them back if the judgment is paid, so keep your receipts.

What is the cheapest way to collect a business debt?

For a single invoice under the small claims limit, a demand letter and then small claims is usually the cheapest route in cash, because court fees stay the same as the debt grows. It costs your time and a hearing. If you would rather hand the work off and pay only from what is collected, an agency fits better.
